Terms and Conditions

WiSpan Internet LLC is a local Internet service provider, referred to hereinafter as WiSpan.

Subscriber is any person, persons, or business that accesses WiSpan in any way, and includes the signee, friends, family, employees, or any other person, or business that uses WiSpan Internet through WiSpan's equipment at Subscriber's premises (CPE). Subscriber may not resell access to WiSpan under any circumstances.

Because of the nature of the Internet and its composition, the operators of WiSpan can exercise no control whatsoever over the content of the information passing through or stored on its network and servers. It is therefore entirely left up to the discretion of Subscriber to judge whether the information accessed is appropriate material. Use of any information, programs or data obtained from or via WiSpan is at Subscriber's own risk. WiSpan specifically denies any responsibility for the accuracy or quality of information obtained through its services.

WiSpan makes no warranties of any kind, whether expressed or implied, for the service it is providing. WiSpan disclaims any warranty of merchantability or fitness for a particular purpose. WiSpan will not be responsible for any damage suffered by subscriber from use of its service including, but not limited to, loss of data, delays, or service interruptions caused by any reason, including negligence, by WiSpan, its employees, its carriers, its other subscribers, or by the subscriber's own errors or omissions.

WiSpan's services may only be used for lawful purposes. Transmission of any material in violation of any US, state, or international regulation is prohibited. This includes, but is not limited to, copyrighted material, threatening or obscene material, or material protected by trade secret. Subscriber agrees to indemnify and hold harmless WiSpan from any claims resulting from subscriber's use of this service which causes damages to subscriber or another party. Any access to other networks through WiSpan must comply with the rules appropriate for that network.

Except for in Subscriber's email account, Subscriber may not add, delete, modify, move, run, store, or copy any file or program to or from any of the WiSpan servers for any reason without the express written permission of WiSpan. WiSpan will remove any such found files, reserves the right to suspend Subscriber's access to WiSpan, and will report all such unauthorized use, abuse, or hacking to the proper authorities for prosecution. WiSpan also has the right to remove, without any further notice, any email of questionable origin on WiSpan's servers, read or not read; and after 90 days, any that are excessive in size.

No one is authorized or allowed to use WiSpan to send SPAM email, or email in bulk to unsolicited persons that has content that was not specifically requested by the recipient, or email that is sent to, copied to, blind copied to, or sent from a bogus email address. Any person found sending such SPAM email, as solely defined by WiSpan, is subject to a pre-defined fee of $10 per email address up to a maximum fee of $200 per day.

WiSpan reserves the right to automatically add a WiSpan SPAM filter and/or WiSpan virus filter at any time and without notice. Subscriber will always have the right to turn off the filters at any time. WiSpan is not responsible for the loss of any email for any reason.

WiSpan's equipment at Subscriber's premises (CPE) remains the property of WiSpan, and WiSpan reserves the right to remove CPE from Subscriber's premises upon termination of service. While equipment remains on Subscriber's premises, Subscriber agrees to take reasonable care of the equipment, and use surge protection to prevent damage from surges and spikes.

All WiSpan services and subscriptions are automatically renewing. On or shortly after the twentieth of each month, the Subscriber will receive an email reminder that payment for their subscription is due on first of the following month, at the pre-established subscription rate. Cash or check payments can be mailed to PO Box 653, Linton, IN 47441. Payment can also be made electronically at www.wispaninternet.com/myaccount. As a courtesy, if WiSpan deems it necessary a past due reminder will be emailed twelve days after the original reminder on any unpaid account. Two weeks after an invoice's due date any account remaining unpaid will be suspended without any further notice, until paid in full, and without any credit to subscriber for any lost time due to suspension. There is a $25 re-activation/late fee for any past due or disconnected accounts. Accounts 30 days past due will be scheduled for deletion and the subscriber will lose all related files and e-mails in their account. WiSpan is not responsible in any way for any lost email, data, or files. WiSpan requires two weeks notice to disconnect an account. A disconnection request will be provided in writing, email or mailed correspondance, before a disconnection request is processed. Customers may use, and subsequentally be billed for, service for two weeks from the date a disconnection request is received.

WiSpan reserves the right to change these Terms and Conditions at any time. The current Terms and Conditions are posted on www.wispaninternet.com. All new and existing accounts are subject to the approval of WiSpan. Any account found to be in noncompliance with these Terms and Conditions is subject to immediate suspension or termination without notification, without any refund to the subscriber, and without any other obligation to Subscriber from WiSpan.

This document constitutes the entire agreement between WiSpan and Subscriber, and the signing of our Terms and Conditions form on the day of Subscriber's installation and Subscribers continuing to use any of WiSpan's services validates this agreement as set forth in these Terms and Conditions as set forth herein.
